What is an unfurnished tenancy agreement?
An unfurnished tenancy — also known as an empty residential lease — is the contract that governs the rental of a property let without furniture to a tenant who uses it as their main residence. It is governed by Act no. 89-462 of 6 July 1989.

An unfurnished tenancy agreement is the legal document that formalizes the rental of an empty property to a tenant who uses it as their main residence. It is governed by Act no. 89-462 of 6 July 1989 and imposes a strict framework on both parties: a minimum term of 3 years, regulation of the security deposit, mandatory clauses, and precise termination conditions.
To draw up a solid lease, state the full identity of the parties, a detailed description of the property, the term, the rent excluding charges and its indexation terms, the amount of recoverable charges, the security deposit, as well as the conditions for viewings, assignment, and subletting.
Before signing, certain documents must be appended: the energy performance certificate (DPE), the statement of risks (ERP), the lead report, the inspection of electrical and gas installations, the entry inventory of fixtures, and the information notice. The lease must be signed by all parties and kept in as many original copies.
